In earlier centuries, restrictive sexual morality could have been justified in parts by the need to care for the children and mothers, and to prevent diseases.

Today, we have powerful contraceptives, safely protecting from unwanted pregnancy as well as diseases. Even if a woman goes home with another guy every night, it will not be a noteworthy risk for anybody, and she can still go for marriage and family, when she likes.

Shouldn't we accept that modern contraceptives have made traditional sexual morality totally useless and obsolete, that no consensual sexual act is immoral anymore, and if we believe in God, thank him for helping the scientists to invent them?

Imagine, no teaching of religion in school, no religious practices in mainstream media, no tax collection of governments for churches, no privileges for religious organizations.

Parents would not be allowed to keep their children stupid by restraining them from scientific teachings, such as sexual education, evolution and similar things. They may still teach them otherwise in private, but not keep them away from knowledge.

It should -not- be oppressive, like in the former communist countries, but still be tolerated as individual freedom, although referred to as nonsense, just like most people today refer to clairvoyance, astrology etc. as nonsense.

On the other hand, oppression by religious people, on topics like sexuality or disbelief, had to be effectively prevented.

Will such a policy make religion disappear or at least a belief of a small minority? Superstition, like belief in clairvoyance and astrology, were common in earlier centuries, but are now hiding in dark corners, with few people openly saying they take them serious.

I mean: why do many or most people have some kind of religious belief? It's against a rational view of the world, so it's hard to imagine how belief in supernatural entities might help for survival.

Is it for forming groups (in higher levels of human development: societies, kingdoms and states)?

Does it spread through discrimination and violence, when believers or religious leaders ostracize, ridicule, expel or kill nonbelievers, creating a major evolutionary disadvantage for them?

Or is it simply a byproduct and side effect, for example, of blind obedience in children, making them accept and later promote even plain nonsense?

When people talk about morality, it's all too much about things like sexuality, qualifying consensual acts with no harm to others as "immoral". Like premaritial sex or homosexuality.

If these things are done in private, not even has anybody the right to call them "disgusting" or "pervert", because he doesn't have the right to judge others' private life by his own preferences.

Can't there be a common, rational morality based on what harm an action does to others, which would restrict immorality to real crimes and harmful actions.

Could such a morality remove pseudomoral, which usually targets anything making life joyful, like sexuality or content of media for entertainment?

People tend to put God in places they don't know about.

500 years ago, people believed God lived in heaven up in the sky, hell was a fiery realm below the surface, Earth was roughly 5500 years old and God created everything in 7 days.

This God has been disproved. Not challenged, disproved!

We KNOW such a God didn't exist! We know above the sky is space, below the surface is solid or molten rock, but no prison realm. We know Earth is about 4.5 billion years old and lifeforms changed and developed through evolution.

Today, those religious people who not entirely reject reason, try to place him where contemporary science has knowledge gaps: Quantum mechanics, big bang, or the first step from DNA-like chemicals to life.

In another 500 years, these topics will likely be explored, and God, as commonly proposed today, will be disproved again.

Where might he be hidden then? What if finally all knowledge gaps about nature are filled?

The law of Mose requires death penalty for bestiality, I think, Islamic Sharia does the same.

Is it to protect animals from cruelty by sexual abuse? Is the harshness of this punishment justified, or should it be more moderate? Or should bestiality even be legal?

Cruelty to animals is the primary comprehensible reason to punish this.

In the laws of Mose, practice of sexual deviations like homosexuality, adultery or bestiality commonly deserves capital punishment, although nobody is harmed by it (except the abuse of the poor animals in bestiality).

But many really violent acts just require a material restitution and moderate punishment.

Islamic Sharia law is similar.

Even today, Christian and other fanatics target homosexuality, adultery and "fornication" far more than actually harmful crimes.

Why?

According to the official catholic teachings, the bread (wafer) and wine in the eucharist do actually turn into the flesh and blood of Jesus, before being devoured. So in the religious belief, the eucharist is about REAL cannibalism and blood drinking!

Macciavelli, Nietzsche (with his master morality) and some followers of Darwin discovered a set of social mechanisms, which prepared the path for anti-ethics commonly called Social Darwinism. It boils down to behaving ruthless and cruel, in order to reach social power, and commonly to abolish all social values making peoples' lives comfortable.

Is this not just a cheap abuse of natural laws for criminal attitudes? Is it not like saying: "We have a natural law of gravity, so we're not supposed to build balloons and airplanes!"? Of course we must consider these natural laws, but shouldn't people try to overcome them? And accept that Darwin and the knowledge about Evolution is not the cause of these evil ideologies, and that we don't need to resort to God and religion for ethics.

Imagine: your parents, teachers and other authorities told you of heaven and that one can reach it by aligning his life to religious rules, creating values and spending money for religious communities.

Then you get a letter or e-mail from Nigeria, telling you can get many million dollars by helping somebody to bring a large sum of money out of the country. There will be efforts in advance, such as communication, traveling to Nigeria and paying several $1000 in advance for attorney and administrative fees, bribes and the like.

Which will you prefer? Is there any reason for your preference, e.g. why you accept heaven as a promise more than the big money?

These are common beliefs among people, a widespread culture with a strong religious trait. Religion is also taught in schools (or even pressurizes natural sciences), so these practices can be a topic in school, too!

Manche Versandhäuser versuchen, ihren Kunden nach einmaliger, günstiger Bestellung weiterhin nunmehr unverlangt Waren zu schicken und dafür Geld zu verlangen. Manchmal wird versucht, mit Formulierungen wie "erkläre mich mit Zusendung weiterer Angebote einverstanden" in der echten Bestellung einen Abonnementcharakter zu suggerieren - was natürlich nicht ersichtlich und damit auch kein rechtsgültiger Vertrag ist.

Laut §241a BGB muss man solche unverlangten Warensendungen nicht bezahlen und auch nicht aufheben oder zurück senden, außer, es ist offensichtlich ein Irrtum (Nachbar mit ähnlichem Namen hat bestellt...)

Jemand könnte sich also eigentlich ganz entspannt von einschlägigen Versandhäusern eine günstige Erstbestellung ordern und die auch bezahlen, aber danach schickt die Firma weiter Waren, die er gar nicht bestellt hat (wobei Telefonate, Rücksendung usw. meist noch durch ausländische Firmensitze erschwert sind) und die er folglich auch nicht bezahlen muss. Rechnungen und Drohschreiben dafür kann er getrost ignorieren, gegen einen möglichen, aber unwahrscheinlichen Mahnbescheid kann er mit fast sicherem Erfolg Widerspruch einlegen (natürlich verrät er nicht, dass er von vorneherein die Praxis unverlangter Warensendungen für sich ausnutzen wollte).

Kurzum, er dreht bei einer fragwürdigen Geschäftspraxis den Spieß um und staubt ein paar mit Recht kostenlose Artikel ab.

Ein Vorwurf solcher Praktiken ist z.B. für die Firma Provea, Firmensitz in Lausanne/Schweiz und ihre Marken Miriale und Tono (Damen- bzw. Herrenunterwäsche), Atlas Verlag (Papierwaren) und weitere bisweilen zu lesen gewesen.

Ist so eine Bestellung zur Ausnutzung von Nepp-Praktiken moralisch in Ordnung, oder sollte man sich nicht auf so ein Niveau begeben, oder ist sowas gar selbst als kriiminell zu werten?

Interessant wären allgemeine rechtliche Aspekte (klar, keine Rechtsberatung für den Einzelfall), idealer Weise Urteile zu dem Thema.

Hintergrund:

Eine Inkassofirma verschickt massenhaft Mahnungen wegen Kleinstbeträgen (z.B. angebliche Call-by-Call-Telefonate), mit saftigen Gebühren drauf. Ein Großteil dieser Rechnungen ist verjährt (älter als 3 ganze Kalenderjahre), also z.B. von 2003, 2004, 2006, ist praktisch nicht mehr nachvollziehbar, weil normalerweise kaum jemand Kleinrechnungen so lange aufhebt.

Kurz: man zahlt nicht, wozu man ja auch laut BGB §194 ein gutes Recht hat, und weil es ein nicht nachvollziehbarer Minibetrag ist, auf den dann oft noch fette Inkassokosten aufgeschlagen werden, hat man auch kein schlechtes Gewissen. Die Forderung bleibt formal bestehen, darf auch angemahnt werden (deshalb sind Mahnschreiben für verjährte Forderungen wohl legal), ist aber nicht mehr einzutreiben.

Jetzt lese ich aber stellenweise, dass deswegen schon Leute bei Schufa oder ähnlichen Institutionen Negativeinträge bekommen haben. Für Schufaeinträge muss aber immer eine Interessenabwägung zwischen Gläubiger- und Schuldnerinteressen stattfinden, so dass z.B. nicht in Wildwestmanier bestrittene Forderungen zwecks Druck auf Schuldner eingetragen werden dürfen, dem Auskunftsinteresse potentieller Gläubiger steht die (von Gerichten hoch bewertete) Kreditwürdigkeit der Menschen entgegen, so dass längst nicht jede Forderung einen Eintrag legitimiert.

Man muss wohl aktiv die Einrede der Verjährung stellen und darf die Mahnungen nicht einfach ignorieren.

Aber: Darf ein negativer Schufaeintrag erstellt werden, wenn man

a) eine verjährte Forderung erhält und ihr nicht aktiv widerspricht, auch, wenn kein gerichtlicher Mahnbescheid beantragt wird?

b) einer verjährten Forderung durch Einrede der Verjährung widerspricht, kein Mahnbescheid kommt und man nicht zahlt?

Ich meine nach einigem Googeln, man müsste mindestens im letzteren Fall Unterlassungsanspruch haben, kann dem Inkassobüro eine anwaltliche Abmahnung zuschicken und die Löschung verlangen. Eigentlich müsste das auch bei Passivität des verjährten Schuldners der Fall sein, denn ein potentieller Gläubiger hat kein berechtigtes Interesse daran, ob man ein legitimes Recht (Verjährung) wahrnimmt, trotz Verjährung zahlt oder die Einrede versäumt und nicht zahlt. Nach der Verjährung muss ein Gläubiger seine Forderung prinzipiell abschreiben, falls er nicht an einen "Dummen" gerät. Das Recht des verjährten Schuldners auf Kreditwürdigkeit dürfte gegenüber diesem -fragwürdigen- Interesse doch überwiegen, oder?
