Will the Army ever grant Waivers for Prior Service Patterns of Misconduct?
Back in 2009 I was given a bogus discharge of Patterns of Misconduct for going "AWOL". My daughter was diagnosed with cancer and my CO refused to allow me to go back home to see her.
My platoon SGT told me to leave and go see her, so I did. My mistake was being an 18 year old Private and not realising that my Platoon Sergeant could not technically allow me leave without paperwork. Which at that time I had no idea.
Long story short, when I got back to my Unit I was chaptered out with a "Pattern of Misconduct" RE3 JKA. General under Honorable Conditions.
I have been trying to get a waiver to get back in since 2010. I have almost given up. Does anyone know if there is a chance they will ever grant this waiver again?
No, this is the complete story. Unfortunately this is how it happened, from start to finish.
I like to think I was a dedicated soldier...Others in my unit would agree.

As dignified as this story appears, you do NOT get a "pattern" of misconduct for ONE incident of AWOL. We'll never know what else you did prior to going AWOL that was in your record, but it obviously was there.
Don't fight the Y!A users that respond to this - we have seen plenty of experiences and know when the details aren't fully exposed. Good luck with your civilian career.

First, the circumstance you describe would have had to be a critical, life-threatening illness to warrant Emergency Leave, verifiable by the Red Cross. If your daughter's life was not in imminent danger (as in she might die before you got home), as unfair as you think it may be, Emergency Leave was not called for.
For that reason the discharge was not "bogus." Add to that the fact that a single incident would not have been and could not have been used for grounds as a "Pattern of Misconduct." There are things you are not telling us.
I was a Navy Junior Officer and I saw almost every circumstance involving Emergency Leave you could see and I also dealt with junior enlisted who made single mistakes and those who repeated their mistakes. The only ones booted out were those who had MULTIPLE issues.
You are not going to get a waiver unless we get involved in a hot, major shooting war. You are wasting your time.

Anyone that has spend more than a week in the military knows that
Edit:
1. No one gets a "pattern of misconduct" over 1 incident
2. Rarely have I ever seen anyone kicked out over a single case of AWOL
3. The Commander decides to take UCMJ action under the recommendation of his NCOs. Any NCO worth his salt would have gone to bat for you if it were as simple as you say.
4. You had the opportunity to fight the discharge during the process...with a JAG TDL; obvioulsy you failed to do that...or..like I said...there is a lot more to this story
You can't BS a bullsh*tter guy...especially one that spent 25 years in the Army
