I need some information about Employment Law?

Is it legal to have someone work 7 days straight when the other 4 employees do not and threaten them with disciplinary action if they don't? Could someone clarify the legal working times etc? Thanks

Update:

So the WTD says its a 48hr Max working week? Anything more than that is illegal?

If you are an adult worker you have the right to either: -

    a. an uninterrupted 24 hours clear of work each week

    OR

    b. an uninterrupted 48 hours clear each fortnight.

So, 7 days on the trot isn't illegal, just not something very desirable, except at peak times or maybe to cover unexpected sickness absence.

The Working Time Regs (the Directive is EU law) in the UK, says 48 hours averaged over 17 weeks, so nothing to stop you doing the odd 50 or 60 hour week, but not regularly. And it is quite legal to opt out of this aspect, though not a great idea. Even if you do opt out, your employer still has s duty to consider your health. Tired workers are more likely to make errors, be rude to customers, or crash vans, so in the long-run it makes no sense.

So, I'm afraid you need to comply with the request, as long as your contract says your may be required on any day. Otherwise it is beyond the contract, and you could refuse - though if you do the consequences may be not what you would want.

    I hope that helps.

    Good luck.

It's not illegal but it's not fair. What is in the persons contract. Many people work a 7 day week on occasions. My husband has worked 16 days in a row many times in catering.

    UK

EDIT: No it's not illegal as many people opt out of the 48 hour week, look at your contract. My husband worked for the UK Government and worked over 60 hours a week on occasions.
