Luckily Cruz can never be president, or even VP or senate majority leader. Those pissant red state senate votes to allow him to run will never hold up in court.

Why would you think he's "flamed out"? He's raising more money than Cruz and the latest poll has him just five points behind Cruz. In Texas, that's huge.
