No, you cannot break your lease without penalty on the basis of a crime occurring. I understand your concern, but a crime in a different unit has not harmed you. You do NOT need to move. You WANT to move. Understand that crimes occur in many places. If you move elsewhere, do you naively think that a crime cannot occur THERE ?

No, crime is not a reason to break your lease. It is a reason to call the cops. Your LL is not in the business of enforcing the law.

"it has been now less than a moth and we need to move do you think we can break the contract because there was crime in the building??"

So, do you want to move because of the crime or do you just want to use it as an excuse?

Begin by reading your contract very carefully. You may find some clause that states acceptable reasons for breaking the contract. Then talk to the person who rented you the unit. If they will not release you from the contract, an attorney is your next hope.

  • Unless it was the landlord that committed the crime, no, you cannot break the lease. Even if it was, until he or she is convicted, you probably have no basis to break the lease.

Generally that's not a reason to break the lease. You could talk to your landlord but don't expect to be let out of the lease.

Crime can and does happen everywhere and is never a reason to break your lease.
