Can I end my tenancy early?

Hi guys,

I just moved into a new flat (in Scotland) and signed a 6 months lease.

There is a lift in the building and it seems to be right next to my bedroom. Now that I have slept there a few nights, I am an absolute basket case because of the constant noise it makes. I know for a fact I cannot stay there if I want to stay sane.

What are my options here?

I know I signed the lease but is there a way around it? Is there a way to get out of there at all?

Have already gotten advice from the council- the only thing they can do is come out an measure it. It will prob just be under their cut-off though. It is more the constant up and down and waiting for the next person to use it that is driving me seriously insane.

Any help would be a lifesaver!

Sorry, forgot to say I am renting with one other flatmate (who's room is fine) and we are renting from a letting agency

    You signed a contract having viewed the flat. In England certainly you would be bound by that contract. All you can do is go back to the agency and ask them if the landlord will agree to putting the flat back on the market (at your expense obviously). If he agrees and the flat re-lets quickly then the landlord will probably let you leave.

    I used to rent out my flat when I moved in with my partner and there's no bigger a nightmare than a tenant who says, "I'm not paying you any more rent and I've got nowhere else to go."

    Tell your landlord you have been sacked, you're working out what to do "but just to let you know, everything's gone belly up and there's no point threatening me or going mad because it's done now and I've got no money."

    He'll spend a couple of days thinking, "Oh f***, I'm gonna lose money here because it takes months to evict a non payer and they always leave the place in a state."

    When he's sweated for a while, you tell him that you've decided to go and live back with your parents, and he'll think "Thank God for that, I've got rid of this potential problem and I didn't even have to waste fifty quid on a solicitor's letter. What a decent guy."

    If you ask him to honour your bond return and amicably annul the contract he'll be only too glad to oblige. Do a bit of theatre about how worried you are "but you've been fair with me and the last thing I wanna do is mess you about, etc."

    Ppl are gonna down this answer because it's encouraging dishonesty, but it's not really a lie, more like a fib.

    if you have signed the lease, you have entered into a legal agreement to pay 6 months rent. you can leave early but will have to pay the 6 months rent still. best to just put up with it for now. invest in ear plugs!!!

    another idea, if your room and the living room are similar sizes, why not swap them around??
