Just need some advice! Can you be sacked for an illness/injury?

I'm on a casual work basis and the past few weeks I've been waiting to get back into work but my boss is hanging up the phone and not replying to any messages etc. It then got back to me that he spoke to someone I know saying that he wasn't going to take me back because I have back and stomach problems. The situation is that I hurt my back when I was covering another girls cleaning work,i'd pulled a muscle so it was painful for a few days, I told them this but I got a load of abuse from the secretary basically accusing me of not wanting to do the job, I had covered that job several times before and never had a prob...my boss was ok about it,he left me fin work at 2.30 for a few days to take the heavy load off.One day he read out the report from the secretary and there was alot of crap added to my complaint so I told him it was wrong and wouldn't sign it and he then told me he would get her to check it and come back to me,to this day he never did. I wouldn't take painkillers (only what my doc gives me) because of an allergy,she laughed at me when I said that and put in the report that I've digestive problems.

I worked my own job for a few weeks after the covering work and never had a prob only that the secretary one kept harassing me,I just carried on with my work.

I am 22yrs old, in good health ,I play football and generally eat well, I don't drink or smoke. I'm rarely ever sick. I have never taken a day off work since I started last Feb,gone in late or mistreated anyone or messed up what I was working on! So I have no complaints against me , verbal warnings or anything of the sort. But I'm worried! Can I be sacked for hurting my back and reporting it? At the time my boss said it was the right thing to do in case I had done more damage and a health and safety investigation would have been opened(It all happened in Sept,I fin my last job at the start of October and i'm off since). Plus I have gotten no notification or anything about being sacked and he won't take my calls, I have been trying with 3wks or more! Also should I go over his head now? Sorry it's so long,any advice would be great!

Also my boss has called in other people before me that were hired months after me and 2 in particular have done some major things while inside there and he lets them off. Such things like taking photos and videos of themselves messing,dancing and singing in work and putting them up online ,phones are not even a loud into work areas because were around tablets and stuff,they also drove a forklift into a wall and covered it up(we are not authorized or trained to use machinery),they go out on all nighters,come in late (or not come in)smelling of alcohol and sometimes they would be falling asleep! This is just some off the things and if the factory found out my boss would loose the contract in there. I don't want to just let it go because I have done nothing wrong and especially in comparison to these people. It's also a bad time of year!

    First of all you need to make a record of everthing said, especially comments made by them to you. Write to head office tell them exactly what you wrote above. Make sure you send it recorded delivery. Tell them because he is not taking your calls (very unprofessional) he has left you no choice but to take it further. Trying to sack staff today is very difficult you have to have verbal/written warnings - none of which you have. The only other way they can get rid of you is serious/gross behavior. Definately take it further and if your boss says anything, tell him you had no choice as well!. Remember any comments/calls/letters - make a record. To be honest though I no jobs are hard to come by but it does'nt sound like a good job. GOOD LUCK!

    I think it's time to look for a new job. Even if they take you back, it doesn't seem like they are very nice and they will always be watching you to make mistakes. If it's a private company they can let you go without reason, they can just say it's not working out. They can also say that you are at risk of injuring or re-injuuring your back due to the nature of the work. Sounds like you should spend your energy looking for another job and not calling them and letting them hang up on you.

    I'd get in contact with the H&S manager at the factory, giving links to these youtube videos, advising him that you "suspect" the cleaning staff also work still-pissed, and bring in phones.

    You ex?- boss might lose a contract but the H&S manager can end up in jail.

    Sorry but if you are on a Casual basis and do not have a permanent contract they do not have to give you work. Casual staff are employed on an as and when basis when needed.

    There is nothing you can do.

    i don't know where you live but if you are injured on the job they cant fire you because of that injury and they cant fire you because of a health problem that is out of your control such as your allergy i hoped it helped but you should consult the labor laws of your state
