If a minor breaks into his brothers house and robs the place is it against the law?
A friend of mine who lives in Mustang OK won a trip. While her and her boyfriend were gone his little brother (17) broke in and trashed the place with a 4 day party and stole a lot of stuff. When they got home and called the local cops they were told that since the younger brother had been a welcome guest in their house there really wasn't anything they could do about it. It would be his word (that he was house sitting) and their word (they told him to stay away). He got in through a window that had a broken lock. She didn't know the lock was broke before they left.
Any thoughts??

It is against the law. The crime is called "breaking and entering." And, depending on local laws, his age might well classify him as an adult, fully prosecutable for this offense.
If the police won't act, one option might be to sue the little brat. That could be harder on him than criminal charges.
However, I think a way could be find to bring criminal charges against him. They should elevate this case--police chief, city council, if needed, mayor, whoever.

How convenient for the local criminals that the cops automatically assume you have some defense before they bother to take a report and start to investigate. Saves a lot of time and hassle for the criminals who might actually not be bright enough to come up with, "He said I could", all on their own.
The interesting thing about that defense is that the defendant has the burden of proving it is true, and the police should not just automatically ASSUME it's true, especially when the victim is trying to report a crime.
Have the friend call the chief and ask where to file a complaint about the poor police response to a crime.

It may not be against the law but it is definitely wrong. Have him place a restraining order on the little brother,. If going on another trip, make sure all avenues of entry are secure, and wipe down all surfaces. Then if there is any damage, there will be absolute proof. And be prepared to press charges. That kind of behavior is habitual.
