Have my rights been violated?!?!?
So I live in a gated community, and me and my friend were out walking at about 10:15 on the sidewalk, just catching up on life. As we we're headed back home, (5 houses down from my house), a police officer stopped and waited for us to come to him. We said "How you doin' officer?" He then got out of the car and was very disrespectful. He asked why we were out, what we were doing. He then demanded for our information: Height, weight, phone #, address, names, ID. I gave him height, weight, and name and that was it...I refused to give it to him. He then called for backup and I was mad, although I never showed it. They questioned us and asked us to empty our pockets, which we did. Then after all this, they explained there was graffiti vandalism all over the neighborhood. Obviously it was not us, as we said, but he made us walk to our house and bring out my dad. He talked to the cops and they acted very nice to him, which really pissed me off. They didn't even apologize for the misunderstanding, they just said ok thank you and left.
WHATS YOUR OPINION ON THIS???
I am mad because I was treated as though guilty before proven innocent, a direct violation of the constitution.
What's your opinion on this?
It's not the fact that he stopped us that we're mad, it's that he treated us as if we were guilty, almost sarcastically, as if he knew we did it.

Violated your rights? How do you think cops will find the graffiti bandits? I would be thankful that they are in my neighborhood and being proactive.
As far as being 'disrespectful' what have you done to be respected? A minor walking the streets late at night. Not willing to cooperate by not providing identification? Just exactly who do you think you are? Johnny Cochran?
I've got news for you my friend, life gets a lot more difficult than this little encounter in your gated community.
I'd learn to 'man-up' if I were you.

No your rights weren't violated. that is complete hundreds of situations an afternoon around the rustic you have been detained whilst officers arrived on scene through situation you have been handcuffed. My guess in view which you have been being a noisy discomfort interior the butt I got here up with this from the certainty which you took a pair instructions in college and are actually a consultant criminal expert and understand each and every thing. you do not would desire to be Mirandized until you're in custody and being wondered with reference to the incident.

not enough facts, age of both of you would have helped, but my advise is just let it go, cops are not always good cops, but frankly....you could have been the ones they were looking for, how do we know you did not do the crime...people always say...i didn't do it...not sure why you were not at your home or their house when you were stopped, why were you walking around, if your homes were in the community...at 10:15, I would wonder too what you were doing, and some of that depends on how old you are

Wow you actually go up to cops and say how are you doing. You actually asked a question and that was your answer. What, did you expect them to tell you that the wife and kids are OK or well I feel a cold coming on...........must be the flu season

foul things were going on in the neighborhood and the police were just being cautious and you can't blame them for that.be glad that their doing their job.you can't let emotions get the best of you.if you have nothing to hide ,you show them what they want to see.the parents did what you should have done and shown some respect and gratitude

It's unfortunate that you were treated this way. However, there is nothing that you can do. It will be your and your friends word against his. Even if you had it video recorded, your chances of an apology is probably worthless.

You do not have to give the police any information. If they cannot tell you why they need it, the crime they suspect you have committed, and why they suspect you then you should ask if you are free to go. Always be respectful. You have 4th Amendment rights against unlawful search and seizure. The act of “seizing” is the officer blocking your ability to freely walk away. If he cannot, right then an there, meet the criteria for a search warrant that a judge requires, then he has no reason to “seize” you and you need to remind him of that.

You might want to keep in mind that your being right won't keep a rogue cop from laying a serious beating on you and then hauling your butt off to jail for "resisting".

Being that it is a gated community, he had a right to verify that you had a right to be there. However, he had no right to be disrespectful to you if you were polite and cooperative.
