Work considers jury duty I excused absence.?

 I have a jury duty summons in a week. I have told my workplace about it. This is what they told me: I have three choices. I am forced to use my PTO two take up those days, work however many days I can’t work on my days off to make up for it or they are considered unexcused absences and count against my attendance. Now I thought that jury duty an employer has to consider that an excused absence. I’m wondering if them forcing me to use my PTO or forcing me to work on my normal days off to make up for that is even legal. I am in Arizona.

    Arizona state law protects employees from discharge or otherwise being penalized for jury duty, but does not require an employer to pay employees for time spent in jury service. However, an employer may run afoul of the FLSA if they refuse to pay a salaried, exempt employee for time off for jury duty. Counting your leave against attendance appears to be a violation. Get unionized.

    What you do is contact the Commissioner of Jurors office and tell them what your employer is telling you. They will straighten this employer out real quick.  They don't have to pay you for days you don't work (you will get paid something by the court), but they cannot penalize you for attendance issues and they cannot force you to use paid benefits. Perhaps you misunderstood that part.  Maybe they told you that if you want to be paid, you have to use those PTO benefits. It will be your choice to use them or not be paid. They can't force you to use them.

    Your employer must let you have time off to serve as a juror. The time you miss cannot impact your seniority rights or vacation time. When you get back to work after serving, you’re entitled to a position equivalent to or higher than the one you had when you left. Your employer may not require or ask you to use your sick leave or vacation time to cover your absence.

    I don’t know the specific laws, but employers are required to make accommodations for jury duty. They don’t have to pay you for time you don’t work, but they can’t penalize you for missing work for jury duty. You should look up the specific laws in your state. You can also ask someone at the court. Depending on the trial, it could go on for weeks. Your employer can’t expect you to make up all that time. Jury duty is something that should be planned for in their attendance policies.
