My husband of 30 years left me and filed for divorce. He kicked me of his Health insurance. Can he do that. We are still married.?

He's not required to have you on his insurance while married, so he's free to remove you. However, part of the divorce order can include that he maintains you on health insurance for a certain period of time.

You need legal advice. We don't know the laws where you live or what kind of health insurance he has (so how easy it is for him to remove/add people to it). Typically most insurances don't allow you to add/remove anyone except during Open Enrollment (usually in the Fall), other than if you get married, divorced, or have a baby. Since you two aren't divorced yet, it would be odd that his insurance would allow him to drop you yet (before the divorce is final).

I am assuming this is the US since we are about the only western country that enriches insurance companies to the tune of 15-20% of medical bills. If it was during Open Enrollment (April for me) then yes, he can. However, I suspect you could pay for the COBRA premium and pay for your own health insurance given the separation. Call the Human Resources department at his company and asked them. You might also call insurance agents about getting your own insurance.

You don't have to have health insurance on your spouse even when you're married. It's his choice if he'd like to carry you as a dependent or not.
