Does my landlord have to replace windows?

My husband and I moved into an apartment ( approx 12 apartments in this building), and the building is about 150 years old. We have old windows here, , 2 of them do have small cracks that have been taped. However, especially in the evenings you can tell there is a LOT of cold air coming through the windows, so we have to heat way more than usual to keep the place warm, there seems to be no insulation whatsoever. Bugs are coming in through the windows, some live - most of them die ( yellow ladybugs/flies/stinkbugs) Some are stuck in between windows and I cant remove them. You can also tell it drafts through the windows, sometimes it even opens and closes doors even tho the windows are CLOSED. We are expecting a newborn any day now and I am wondering if there is a law in place that says he has to replace the windows ( I doubt foam would sole the issue tbh), we were told they might cover the windows with plastic from the outside, well great...

This is in the state of VA

Of course we looked at it, your comments dont help me one bit. There were no bugs there at the point we moved it.

    You rented an apartment in a 150 year old building with gaps, bugs and tape in the windows. Did you look at the unit before you signed the lease? I'm sorry, but the onus falls on you. Why would the owner invest in new windows as long as people continue to rent the property? I'm afraid that moving is your only and best choice. Take plenty of pictures before you leave as you might neeed them when the landlord sues you for breaking the lease.

    Just a question. Why didn't your landlord renovate the place before you guys moved in? Screw what the law says. Lets use a little common sense here.
