Can they get to my husband for my credit card debt?

My husband and I are separating, I am thinking about going home to my country, germany, but have many credit card debt. Can they go after my husband? I do not want that. Should I rather file for bankruptcy and than leave?

We are n Los Angeles, CA.

    CA is a community property State so as long as the debt was incurred while you were married yes they can and will go after your Husband.

    I am not from California, and they have very different laws than the rest of the U.S. But I believe that if you file for bankruptcy, it could affect your husband's credit. He may not be able to get a bank loan to purchase a house or a car after a bankruptcy. Instead of him getting a 5% loan to buy a car, he might have to pay 18%. I believe CA is a community property state, so you should consider shopping around for a decent and affordable attorney if you're separating. That way, you won't be leaving with the guilt of your husband being forever in debt because you bought too much and lived beyond your means.

    I do know they can if you 2 have any joint accounts. Now if this is just your credit card acct i don't think they'll come after him. But since it's a communal state this COULD be another story. Especially if you racked up the debt while you were married to him. To really find out is to call a lawyer and ask her/him. They know these types of things. They'll help you out. But divorces can be expensive. =S Good luck with your situation in the future.

    I have had experience in this department. They surely will try to make your husband pay. However, they can not do anything if your husband is not on the account. If he is not and they continue to try, contact your State's Attorney Generals office.

    Of course they will go after him. Just do what most wives that rack up all the debt do, just leave the country and say "it's his problem". You guys are breaking up so who cares. He's the idiot for marrying you. Some men are so blind. So that's his problem.

    They cannot unless he co-signed on the accounts.

    If you live in a community property state they could go for the property you both hold in common but only after your divorce, they cannot touch it as long you remain married.

    It's very rare though for a credit card company to file lien on community property over and unsecured debt, the legal procedures are long, expensive, they won't get anything until the couple divorces and if the consumer fight back they might not get it in their way.

    After the divorce when the community property is divided among the ex-spouses is too late for the credit card company to do anything. Just don't let them know that you are divorcing.

    If he didn't sign for the debt. He doesn't owe the debt. Plain and simple. Community Property state or not. You are not responsible for another persons debt. Married or not. If you own anything with your husband Like a house. They can get your half of the house.

    Only if the accounts are joint. If it is your personal credit cards they can not. I work in a community property state and that is still the case (Just had a women who was still married purchase a property and her husband's collections were NOT on her credit...she asked about CREDIT CARDS not real estate or tax liens) Good Luck
