Are the terms of the original lease still in effect three+ years with no lease?
Signed one-year lease 2.05. I've paid the same rent since, and have never signed a new lease or a renewal. Am I obligated to remain on the property until 2.10? (Can't find my copy of the original lease.)
Glad to see the answers are consistent. I am in New Jersey. I have already sent written notice that I will be vacating the premises by July 1, so I am giving more like 75 days' notice. Just wanted to be sure I was doing the right thing--he's a fair landlord.

to your question. YES, the terms of the original lease are still in effect.
However, you are on a month to month and can end with a 30 day notice.
NOTE: the notice starts on the first of the month. If you give notice on April 15, it would become effective May 1 and you need to move by May 30. Plus you pay for the full month of May.

In most cases, when a lease expires the contract will move to a month-to-month situation where both parties must give 30 days notice to quit.

Generally, no. When a lease expires, you go month-to-month, which means you can legally move on 30 days notice.
