Who knows Child custody laws?
Ok, my friend has an unruly teenage daughter. They got into an argument one day and the daughter left the home to go to the house of her younger brothers' father (who she has had a semi father/daughter relationship with for almost 10 years). He is not her biological father and has no blood relation to her, but he was able to file for custody of her.
My friend seems to have exhausted her means to get her daughter back into her home-the child refuses to comeback and officers won't get her out. There is no complaint of abuse or neglect, but my friend doesn't understand how a man that isn't biologically related to her daughter be able to do this?
Let me know if you need further details...
She has not deemed unfit-As a matter of fact there is the same thing the "father" is doing for my friends son. She filed for child support in May, Paternity confirmed in June, "Father" files for custody of son in August, My friend gets temporary custody because the facts didnt add up. Now he's doing what he can to not only not pay child support, take their son away, and take her biological child away.
She was a young mother and sole provider of her daughter-there was never any idea on my friends part thatshe needed to get legal custody, because there was no one to challenge custody.

Unless your friend has been deemed unfit, there is no way she would not be able to maintain custody.
Either you don't really know the whole story, or she needs to get a lawyer.

She needs to go to court. There is no reason she should not be the legal guardian of her child.
She should do it soon too. Courts place a lot of weight on how things have been done in the past, and the longer her daughter stays with him, the better his argument will be in court. Though honestly, it's still not very good - IF you've got the whole story.
There's a pretty good article below that talks about what you need to know before going to court. I hope it works out for your friend.

The age of the teenager may have something to do with the case.
Your friends need to get the case number and find out what was said in the original documents filed by the son's father.

Who has legal custody. If it is the mother she needs to file a police report that her daughter is a runaway and go and get her. There is no way I would allow my daughter to leave my home and live somewhere else without my permission.
