my wife had me wrongfully arrested and took my 5 children out of the state(tn).what can i do legally?

she said i hit her while i was working.she also got an order of protection under false pretences in mi.i really need some direction.

    Unfortunately it's her word against yours, and also unfortunately, courts tend to side unfairly with mothers.

    I would talk to a lawyer and see if you can't get this straightened out.

    I am not sure how the thing reads in court , but I do know that the woman is no longer automatically given custody of the child . If you two are not divorced and going by some decree the court set up then she can't legally keep you from the kids . If I were you, and get an order from the court allowing you visitation rights and/or petition the court for custody of the kids . That will at least make her have to come home to face you in court .

    Can you prove you were at work? That one little bit of information can get you off the hook. Also, what was your wife doing before she made this claim? was she out with friends? shopping? you need to find out what she was doing before she reported you and after, there could be clues to prove she was lying. Speak to all her friends and neighbours, she would of told someone something, and if they had an ounce of decentcy they will tell you if she said anything. And then you have a witness. As the report was made in the state your in, if new evidence comes to light, she might be required to move back, this is when you can supervision rights.

    Also what does the protection of order say? is it banning you from complete contact? If not get on to a lawyer, they will help you.

    First of all you have to prove that you are innocent, then once proved, you can take her to court for kidnapping the child. Parents don't have the right to take a child out of state without first consulting with the other parent. Move fast though because the longer you wait the more it will Look like you really don't care and your out to just hurt the mother of the child.
