From what I understand, it takes seven years for a person to be declared legally dead in the US. This is the only way you could remarry if your spouse were to go missing. They would either have to be found dead or declared legally dead. And I'm pretty sure an effort has to be made to track her down.

If u were married then it takes 7 years before u can have them legally declared dead . . . if the spouse just walked away then u can get a divorce for reasons of desertion then remarry as soon as divorce is final.

Long enough for the police to find her...there are legalities and if your spouse has gone missing you need to notify the police. You also might want to hire a lawyer, the police invariably accuse the other spouse of some type of crime when one goes "missing".

What do you mean "missing". Anyway, grounds for abandonment depend on the state. Get a lawyer. Uh, you'll probably need a criminal attorney, though.
