As long as you filed Married Filing Separately last year and not as single or Head of Household you should be okay. You would now be single or HH since you were not legally married at the end of 2007. They cannot take your money unless it was owed when you filed together.

If you filed a separate return for 2006 then the can NOT go after you for HIS tax debt from 2006.

Did you have unreported income in 2006? If you did, you need to file your own tax return for 2006 as married filing seperate.

If he didn't do his 2006 taxes, you aren't responsible for them unless you filed a joint return with him. If you filed your own return and claimed all of YOUR income for 2006, you should be OK.

Note though, if you live in a community property state, special rules apply - and usually each spouse is responsible for half of the joint income
