Im an Electrical Engineer for a large chemical company. I love my job and have always been very interested in electricity. I have previous education and experience as an Industrial Electrician and as a Residential/Commercial Electrician. Even so I don't claim to know everything and am always willing to learn to better benefit myself. I drive an 07 Ram Quad Cab 4x4 6 speed with a Cummins Turbo Diesel. I really like my truck and have done a few things to it, mostly to improve mileage and reliability. I had a 94 S-10 4 cyl 5 speed as my daily driver. It was totaled on Oct 29, 07 when a passed out guy hit me head on. My g/f and I were very lucky to make it out alive. She got two broken ribs and I ended up with a broken femur and kneecap. I'm hoping to get a 1500 Chevy 2WD V6 automatic to drive to work. I cant wait to get back to work! I miss all my coworkers and want to get back and do my part! Until then Im on here answering questions. Hopefully Ill be back by the end of January!

  • Legal loophole for possible incapacitated driver?

I was recently in a head on collision that was not my fault. The other driver has had passing out problems in the past. I do not know whether he was passed out or not. The accident happened in Virginia.

I'm shopping for lawyers and one has told me that if the other driver was passed out then he would not be considered at fault and basically I'd lose any settlement.

Are there such loopholes where a driver that is incapacitated momentarily would not be considered at fault in the collision?

    Thank you for your help!
