  • Leaving work on time... get a write-up?

    If an employee has perfect attendence, no lates and/or absences, and no issues with behavioral or productivity issues, can he or she be written up for leaving on time?

    The situation is as follows: A store is short-staffed with hourly cashiers. The customer service desk consists of three employees plus a fourth to answer all the incoming calls (the telephone operator). A supervisor takes two employees away to cover other lunch breaks in other areas of the store. This leaves a single customer service rep and the operator who both leave at the same time. The service rep informs the supervisor that he/she has to leave on time, but the reponse is have to wait until a replacement comes, approx 15 minutes after the scheduled end time.

    The end of shift arrives, the telephone operator leaves. All customers are taken care of, there are no outstanding lines or actual customers waiting anywhere and the cust service representative decides to leave as well. This leaves the service desk empty.

    Does the employee who left exactly on time deserve a writeup for leaving the service desk empty, or is the supervisor at fault for not properly time managing?

    (Although short-staffed on hourly cashiers, there were ample dept managers on hand to help out).

  • 401K to IRA to trying to withdrawal tax question?

    Here's the situation, I lost job 6 months ago and had $45000 in 401K. Due to hardship after that, I had to cash out... After taxes and fees the check was for 25000.

    When I went to deposit the check, the bank convinced me to open up an IRA account. Now, if I were considering taking that money out, am I right to assume that I would lose half of that as well?

    I figure I was better off with the 25K I already had in my hand. Is the 25K that remained, after all applicable taxes were taken out the first time, in actually my money?

  • 401K early-distribution tax question...?

    So lost job in Sept 2012 and had a 401K account that totalled 36K + a 9K outstanding loan...I did nothing, and I was sent a check three months later. Even though the check was dated 12/27/12, I didnt physically receive it until 1/2/13. I immediately went to bank and put part of the money (25K) into an IRA. ( I needed the balance for hardship plus education expenses. )

    Since the initial 401K check was dated 2012, I received the 1099R that showing the entire amount distributed (45K). It was partially rolled over into a new account within the 60 day threshold, but am wondering what the heck to report on my taxes??? The new IRA account was created in 2013...

    So far my best guess is that the initial gross distribution minus the 25K is taxable...

  • Parents taking advantage of power-of-attorney?

    Just curious on this one... a little background first. My grandmother had a stroke ten years ago and then was confined to a wheelchair because she became paralyzed on one side. During the rehabilitation process, she had many overnight hospital stays. On one particuliar night, she fell out of the bed, possibly causing more injuries. My mother is a RN, not at that hospital, believes she could do no wrong and is the perfect nurse. Of course, she wanted to see my grandmother's charts and care, etc., etc., to criticize and pinpoint every little thing that was done wrong and what she would have done or prescribed instead. They (my parents) decided to sue, on behalf of my grandmother the hospital for negligence. And they won $1.5M.

    My grandmother has always had a very limited income, in fact, was just getting by paying rent in a small 1-bedroom apartment. Coming from NYC, she never owned or lived in a house. I believe she was on Medicaid at the time. My parents are middle-income, and own a modest 3-bedroom older style ranch, nothing outlandish.

    Somewhere along the lines, my parents had power-of-attorney over the money. Some of it was used to buy a similiar type house for my grandmother. Since my grandmother now had money, she lost the Medicaid benefits, which is only fair, so some $ had to be used for a live-in nurse and other expenses. My parents also bought another ranch across the street from where they live, with the intentions of renting it out or reselling it a profit.

    Just a note: these two houses were each bought in full, and BEFORE the housing market crashed. Basically, they overpaid for these houses by todays standards.

    Today (ten years later), my parents decided to put in an offer for a ridiculuous 9-bedroom estate. They plan to use the money from selling the two ranches, plus take out a loan. It's for them only, my grandmother has no idea, nor was she even included in the negotiations. I asked whether she would live there too, my parents said no, but only if my parents have trouble with the finances with the house. They decided on the estate because it "looked great", built in 1912, and was a great deal (was 2.6M, purchased for $875,000)

    This is in the Long Island market, where the taxes are ridiculous by the way. Anybody else see anything wrong with this?

  • Can I still collect New York State Unemployment if....?

    I was just laid off from an assistant manager job, a position I held for 10 years, the pay was good, unfortunately the unemployment benefit is no where close to what I was making per week. I will be getting the max, I believe $405 a week.

    I was technically unemployed for two weeks (the 2nd week should be covered by insurance), but then I accepted a night stock job at Target. It basically pays exactly the same as the unemployment check would. I worked for a week, but I found out the job is the freezer and grocery stock person. Not even a supervisor or lead position. Simply, the job is not what I signed up for.

    The question is, can I quit and still claim unemployment (not for the week, of course)... The rules for unemployment in NY is that I must accept a job if it pays at least a percentage of the amount you were making (I think it was 80%). I accepted a job that paid far less than that and I'm afraid if I quit it will disqualify me from claiming unemployment from my original job.

  • Anyone know this music video, red riding hood theme?

    Maybe a longshot, but maybe someone recognizes the description of this video and who who sings it, name of song, etc... It's sung by a black singer, and takes place in the woods. I believe it has a little red riding hood theme to it, because as he is singing, he sees her, I actually it may be a sexy cartoon woman version of her. As the video goes on, he's following her through the woods trying to find her. At the end, he finally catches up to her, and she lifts or turns her hood, revealing that she's the grim reaper. Anyone have any idea what video this is?

  • Slab plumbing leak-- turned off main water valve... turn off boiler?

    Chances are, I have a slab leak somewhere within my house. We just noticed the running water sound, and the water meter was spinning even though no water was being used. I'll call a plumber ASAP to deal with this...

    Right now, I turned off the main water valve so I have no water whatsoever.

    Should the boiler be turned off as well? I'm not sure if it will be affected if no water is running through it or not.. (I do not have a separate hot water tank). Do I turn off the heat?

    And what are the signs of a cold water versus a hot water slab leak?

  • TAX QUESTION! Paying $ to sister who babysits...?

    I know there is a child-care credit avavilable on our federal and state returns, and we are eligible to use them. But my wife and I are wondering how it affects her sister's return...

    My wife and I both work full-time and have a 1-yr old daughter. We paid my wife's younger sister to babysit throughout the year. The babysitting was necessary because our work shifts sometimes overlapped. The sister is a dependent on her parents' return.

    We wanted to claim that credit, because we paid her about $3K last year. But if we do so, does she have to file taxes as well? And do her parents have to report that income since she is a dependent? She has no other income, and is a full-time high-school student.

    (If it doesn't affect her or her family, please link a reference so I can show the parents.)

  • Can a company trace customer service letters?

    Suppose you want to complain about a store and you go to the company website and fill in one of those customer service complaint forms. The email sent to the company is from THEIR actual website not your personal email... can it be traced back to your specific computer to identify you?

  • Trying to print Adobe .pdf file, default printer issue?

    I've noticed that I am not the only one that has an issue with printing Adobe .pdf files... I try and print my document and the error message comes up saying:

    "before you can perform print-related tasks such as page set-up or printing a document, you need to install a printer."

    I know how to set the default printer, and have been doing that, except here's the problem....

    A green check-mark is SUPPOSED to appear when you set the printer as the default printer. That's not happening for me.

    I have one printer and am running Windows XP SP2. Every other file prints fine with no issues.

    Why isn't the green check-mark appearing? Any other ways to print a .pdf file?

  • Lawyers: About to sue person in small-claims court, then.....?

    received notice that he just filed for bankrupcy. Can I still sue him?

    I sent a notice to him 10 days before he filed. I also have not filed paperwork to sue him yet, so technically I am not a creditor. (The letter I received mentioned that creditors can't contact him.)

    Any advice?

  • Should we attend wedding and/or reception?

    Hey, here's one for you. My wife and I have been invited to our friends' ... well maybe acquaintances... wedding in October. We have known them for over five years. They expect us to go, and normally, without a doubt we would go.

    However, here's a little history. We know them and have hung out with them for a long time. Not an everyday thing, but every so often. We have done things for them throughout the years, and we don't expect anything in return.

    For example, we own a timeshare and invited them to Vegas, free accommodations. They said they would take us out to dinner. That never happened. No big deal.

    We buy them small gifts for Christmas and birthdays, nothing big or fancy, usually gag gifts or something cool but inexpensive that they may like. Again, no big deal. We really aren't looking for anything in return.

    My wife and I had a daughter last year. They promised to get her something. Nada.

    My wife and I got married this past spring. Neither of them attended and said they couldn't get off work. Again, no cards or anything.

    Our daughter turned 1, we invited them to the party. They didn't reply to the RSVP, show up, or even get her a card. Not even a phone call.

    They keep saying that they will do something for her and apologize for not showing up. We don't care really because we know they are full of b.s. at this point.

    Now, we receive their wedding invitation. It's an inconvenience to drive to the actual wedding, it a bit far and in a congested area of Long Island. The reception is being held closer to where we live.

    Hmmm... should we turn the table on them and not do anything for them? Should we even get them a card or gift?

  • Tax question: Head of household?

    Anybody know for sure on this one? I'm single and live with my fiancee in a house in which we rented for all of 2008. We have a daughter. On this year's taxes, because we are unmarried, my fiancee will claim her on her tax return as her dependent. Since I satisfy the requirement for paying all the costs for home, can I claim the head of household status?

    The requirement for head of household says I must pay most of the costs for home and providing home for someone who I can claim as a dependent. I can claim my daughter, but am not, because she will be claimed on my fiancees tax return instead.

    Does that affect my status, because since she is claimed already on someone else's return?

  • wedding travel question--- ok, i was invited to wedding and....?

    I received an invitation to an ex-best friends wedding. We have known each other for twenty years, mainly grade school and high school. We used to be the closest of friends but in the last five years we drifted apart and never hang out at all as we used to. Most likely we would be total strangers to each other if it weren't for the fact that we work together in a drugstore where he's the manager and I'm the assistant. For the most part we get along fine at work, not perfect, but pretty decent.

    The wedding is 900 miles away. I would have to pay for airfare and at least two nights stay at a hotel. I expect the expenses to be around $500, not including a gift. Years ago, there would be no doubt I would go... but since I'm not the best man or even a groomsmen, I wonder if I should go.

    I have money but I was planning on using it for separate vacation for my GF and I. Two questions: Should I go, and second, am I obligated to tell him a reason for not going?

    I don't know if rumor or not, but its circulated that yankee pitcher corey lidle may have been one of ones killed on that plane that

    crashed into the side of the building in Manhatten.

    If it's true, thats messed up. I'm sure just an accident, but a strange coincidence esp. after the yankees were badly beaten in their postseason series with the tigers.
